By accepting these terms and conditions ("Terms") or accessing or using the Services, you acknowledge that you have read, understood and agreed to these Terms.
You agree not to use the Services in a manner that is unlawful or that interferes with or disrupts the integrity or operation of the Services and its components. You understand that the technical processing and transmission of the Services, including your data, may be transferred unencrypted and involve (a) transmissions over various networks, and (b) changes to conform and adapt to technical networking requirements. or devices and (c) transmission to Bike Booking Engine SL's suppliers and partners who provide the necessary hardware, software, networking, storage and related technology necessary to run the Services and revenue operations. Any negligence or failure of Bike Booking Engine SL to enforce any of these Terms shall not be construed as a waiver or variation of these Terms or otherwise prejudice any of Bike Booking Engine SL's rights under them. You agree not to reproduce, sell or exploit any part of the Services, use of the Services, or access to the Services without the express written permission of Bike Booking Engine SL.
Bike Booking Engine may update and change the Terms from time to time without notice. Any new features or tools will be considered part of the Services and subject to the Terms. Your continued use of the Services after any changes will constitute your consent to such changes.
You must be at least 18 years old to use the Services. To use the Bike Booking Engine Service, you must register for an account by providing your full name and email address and any other information indicated as necessary. We may reject your application for an account, or cancel an existing account, for any reason, in our sole discretion.
You are responsible for keeping your password secure. We cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and/or password. You acknowledge that Bike Booking Engine is not PCI compliant and you agree not to store any sensitive third party information within Bike Booking Engine including, but not limited to, credit card data and other sensitive personal data.
Bike Booking engine uses a third-party payment gateway, so under no circumstances will Bike Booking Engine be responsible for any problem with the service, with the company providing the service being responsible. Each transaction made through our booking engine has service fees. View commissions
The services are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Bike Booking Engine SL expressly excludes any warranty, whether express or implied, whether by common law, statute, trade usage, course of dealing or otherwise. The user expressly accepts and acknowledges that Bike Booking Engine SL does not guarantee that the services will be uninterrupted, timely, secure, error-free or virus-free and no information or advice obtained by the user from Bike Booking Engine SL or through the Service will create any warranty that is not expressly stated in these Terms. Under no circumstances, whether in contract, tort, or otherwise, will Bike Booking Engine SL be liable to you or any third party for any direct or indirect damages (including loss of profits, loss of sales or business, loss of data or business interruption). It will be your responsibility as the user or account holder to ensure that any aspect of the Services that you propose to use on your own equipment is compatible with such equipment or your own software, and we will have no liability for any lack of functionality or damage suffered as a consequence of said compatibility. However, nothing in these Conditions shall be deemed to limit or exclude the liability of either party for any act or omission the exclusion or limitation of liability of which is prohibited by law. We shall have no liability whatsoever in relation to any products or services purchased, rented, leased or otherwise obtained through the Services, and you agree that no action shall be taken against us in the event of any damage or loss suffered by any third party.
We reserve the right to modify or cancel the Services for any reason, without notice and at any time. We reserve the right to refuse service to anyone for any reason at any time. We may, but have no obligation to, delete, suspend or terminate an account if we determine in our sole discretion that any goods or services offered through the Services violate these Terms. We reserve the right to offer our services to competitors and do not make any promises of exclusivity in any particular market segment. Additionally, you acknowledge and agree that Bike Booking Engine SL employees and contractors may also be clients/merchants of Bike Booking Engine SL and may compete with you.
Any failure of Bike Booking Engine SL to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and the documents they incorporate by reference constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreements between you and Bike Booking Engine SL (including, but not limited to, any prior versions of these Terms .
The creation of an account or any use of the Services will not constitute the transfer of any ownership of Bike Booking Engine SL's intellectual property rights to you or any other third party. We do not claim any intellectual property rights over any content or information you provide when using the Services.
There is no cost to using the Bike Booking Engine service to find a bike rental shop.
The fees associated with renting a bicycle are set by the bicycle shop from which you agree to rent the items. The general conditions, privacy policy and other policies of the bicycle shops will apply.
The Bike Booking Engine service is billed monthly and is non-refundable. For any mid-month plan level upgrades or additions, you will be charged a prorated amount for the current month, and then the full new amount for the following month onwards. Prices for all Bike Booking Engine Services, including but not limited to monthly Service fees, are subject to change upon 30 days' notice from us. Such notice may be provided at any time. However, you will be issued an invoice for 1 month of service with a FIXED price. This price will be guaranteed for the specified period. Your account may be suspended or canceled if you do not pay fees when due.
You can cancel your entire account or additional Bike Booking Engine modules at any time from your account and without prior notice to Bike Booking Engine. In the case of canceling a module in the middle of a billing period, said module will remain active until the end of the current billing period and will automatically be canceled for the next billing period. Under no circumstances will a payment be made for cancellation before the billing end date of the current period.
All your data will be deleted from the Service upon cancellation in compliance with data protection laws one month after cancellation, however you will be able to download your reservations before this data is deleted. Bike Booking Engine has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any violation of these Terms or any other applicable policy.
These Conditions will be governed and interpreted in accordance with Spanish legislation. Any dispute arising from the use of the Service will be subject to the jurisdiction of the courts of Palma de Mallorca in Spain.
